Terms of Service

MadeforMe provides custom website design and web application development. The specific scope of work for each project will be agreed upon in writing prior to commencement.

2.1 Setup Fee

A one-time setup fee is required before work begins. This fee covers the design, development, and launch of your website or application as outlined in the agreed scope of work. Setup fees are non-refundable once work has commenced.

2.2 Monthly Fee

A recurring monthly fee covers maintenance and ongoing technical support. This fee is billed monthly and must be paid on time to keep your website active.

2.3 Late Payment

Failure to pay the monthly fee within 7 days of the due date may result in suspension of your website until payment is received. MadeforMe reserves the right to take the website offline for non-payment.

Domain name registration is NOT included in any service package offered by MadeforMe. The Client is solely responsible for:

• Purchasing and registering their own domain name
• Renewing their domain registration annually
• Managing their domain settings and DNS records
• Any costs associated with domain name ownership

MadeforMe can assist with connecting a purchased domain to your website, but this does not constitute ownership or management of the domain on your behalf.

4.1 Bug Fixes

MadeforMe will fix any errors, bugs, or functionality issues that result directly from our own development work at no additional charge. This includes issues present at the time of launch or introduced by our updates.

4.2 New Features & Enhancements

Any additions, changes, or enhancements to the original agreed scope of work requested after project completion will be treated as new work and billed accordingly. This includes but is not limited to:

• Adding new pages or sections to an existing website
• New functionality not included in the original scope
• Design changes or rebranding
• Integrations with third-party tools or services
• Additional automations or scheduling features

MadeforMe will provide a quote for any requested enhancements before work begins. No additional work will be performed without written approval from the Client.

4.3 Content Updates

Minor content updates (text changes, image swaps) are included in the monthly fee based on what pricing package you have. Requests exceeding this limit may incur additional charges.

5.1 No Sensitive Data

MadeforMe does not build systems that process, store, or transmit sensitive personal data including but not limited to payment card information, Social Security numbers, medical records, or financial account details. Clients should not use MadeforMe-built systems to collect or store such information.

5.2 Data Breach Disclaimer

MadeforMe makes reasonable efforts to follow standard web security practices. However, MadeforMe is NOT liable for any data breaches, unauthorized access, hacking, data loss, or any damages resulting from security incidents affecting your website or application. You acknowledge that no system is 100% secure and that you use our services at your own risk.

5.3 Third-Party Platforms

MadeforMe builds websites using third-party platforms and tools. We are not responsible for outages, security incidents, pricing changes, or service discontinuations on the part of these third-party providers.

To the maximum extent permitted by law, MadeforMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of revenue, profits, or business opportunities
• Loss of data or website downtime
• Damages arising from third-party platform failures
• Any harm resulting from use or inability to use your website

In no event shall MadeforMe's total liability exceed the total amount paid by the Client in the three (3) months preceding the claim.

7.1 Client Ownership

Upon full payment of all setup fees and outstanding balances, the Client owns the final website design and content as delivered. MadeforMe does not retain rights to your specific website content.

7.2 MadeforMe Rights

MadeforMe retains the right to use screenshots, links, or descriptions of completed work in its portfolio, marketing materials, and social media, unless the Client explicitly requests otherwise in writing.

7.3 Code & Tools

Underlying code frameworks, tools, templates, and development methods used by MadeforMe remain the intellectual property of MadeforMe or their respective third-party owners. The Client receives a license to use the delivered website, not the underlying development tools.

The Client agrees to:

• Provide accurate and complete information required for the project
• Supply any content, images, logos, or materials in a timely manner
• Review and approve work in a timely manner
• Make payments on time as agreed
• Not use MadeforMe-built systems for any illegal or harmful purpose

Delays caused by the Client's failure to provide required materials or approvals may result in project timeline adjustments and are not the responsibility of MadeforMe.

9.1 Client Cancellation

The Client may cancel monthly services at any time. Setup fees are non-refundable. Upon cancellation, MadeforMe will provide the Client with access to export their website content where technically possible.

9.2 MadeforMe Cancellation

MadeforMe reserves the right to terminate services at any time for non-payment, violation of these terms, or any conduct deemed harmful to MadeforMe or its reputation. In such cases, a pro-rated refund of the current month's fee may be issued at MadeforMe's discretion.

MadeforMe does not guarantee 100% website uptime. Downtime may occur due to hosting maintenance, third-party platform issues, or circumstances beyond our control. We will make reasonable efforts to resolve downtime issues promptly but accept no liability for lost business resulting from website unavailability.

All services are provided on an "as is" and "as available" basis. MadeforMe makes no warranties, express or implied, regarding the fitness of the website for a particular purpose, uninterrupted operation, or that the website will meet all of the Client's expectations.

This Agreement shall be governed by and construed in accordance with the laws of the State of New York. Any disputes arising from this Agreement shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration in New York.

MadeforMe reserves the right to update these Terms of Service at any time. Clients will be notified of material changes via email. Continued use of our services after notification constitutes acceptance of the updated terms.

This Agreement, along with any project-specific scope of work agreed to in writing, constitutes the entire agreement between MadeforMe and the Client and supersedes all prior discussions, representations, or agreements.
